Irish ARF or annuity while living in Belgium: tax considerations for 2026–2027

Irish ARF or annuity in Belgium? Treaty treatment differs. Check residence, Belgian taxation, PRSI eligibility and retirement lump-sum limits for 2026–2027.

An Irish ARF and an employment-related annuity can receive different cross-border tax treatment. An annuity may offer a clearer treaty route, but Belgian taxation and any Irish pension entitlement depend on individual circumstances.

This framework concerns income years 2026 and 2027; the figures below are illustrative, not a reconstruction of a client’s finances.

Start with the pension arrangement

Consider a retiree living in Belgium with Irish additional voluntary contributions (AVCs). The decision is whether to retain an invested fund through an Approved Retirement Fund (ARF) or use available retirement capital to buy an annuity.

Three separate questions matter: which country can tax the payment, how that country classifies it, and whether any social insurance contributions create pension rights. An Irish product label does not answer all three.

Establish residence before choosing a payment year

Ireland’s residence tests include 183 days in one tax year or 280 days across the current and previous tax years. A person present for 30 days or less in a year is not resident under these day-count tests. Presence for part of a day generally counts.

For a proposed payment in 2026, examine 2025 and 2026; for 2027, examine 2026 and 2027. Delaying a payment until January does not itself establish non-residence.

The Ireland–Belgium convention has unusual residence provisions: Article 4 and the dual-residence rules in Article 23(3) must be considered together. Do not assume that simply identifying a main home settles treaty entitlement.

Why ARF withdrawals need a separate tax analysis

Revenue generally taxes ARF distributions under Schedule E, regardless of the recipient’s residence, and does not issue a PAYE Exclusion Order for them.

For treaty purposes, its guidance requires examination of the underlying income, gains and capital represented by the withdrawal. An ARF withdrawal therefore cannot automatically be treated like an ordinary pension paid abroad.

Before choosing an ARF, obtain the information needed to analyse those components and the Belgian treatment. A Belgian tax claim alongside Irish withholding creates a potential double-taxation problem; relief should not be assumed.

Why an annuity may offer a clearer route

For an employment-related pension falling within Article 18, the treaty generally allocates taxation to the qualifying recipient’s country of residence. That can make Belgium the taxing country for an eligible annuity.

Revenue’s PAYE Exclusion Order procedure can remove Irish income-tax and USC withholding where the relevant conditions are met. Eligibility, residence evidence and the provider’s procedure should be confirmed before payment.

Government-service pensions have separate treaty rules and should not be grouped automatically with a privately provided AVC annuity.

The commercial comparison also matters: obtain actual annuity quotations, including any guaranteed period. Compare income security, access to capital and what happens on death.

Belgian exemption is a question to resolve, not an assumption

The source analysis identifies Article 39, paragraph 2, 2° of the Belgian Income Tax Code as relevant to the possible exemption of certain insurance benefits. Its application to a foreign AVC requires scrutiny of the contract and its pension context.

Evidence should cover:

  • the legal form of the arrangement and its relationship to an employment scheme;

  • who paid the contributions;

  • the tax relief previously obtained;

  • whether the benefit is paid as capital or as a periodic pension;

  • whether an annuity is part of the original arrangement or purchased separately.

Do not infer exemption merely because the employee funded the contract personally. Equally, an Irish tax-free payment is not automatically exempt in Belgium.

The useful next step is a documented Belgian assessment, with an advance ruling considered before an irreversible transaction. Until classification is resolved, a precise Belgian net-income forecast would be premature.

An ARF is not automatically a route to Irish State Pension rights

The Department of Social Protection’s Class S guide excludes non-residents whose income is solely unearned income. It also identifies separate restrictions for certain recipients of pensions from previous employment.

A plan to withdraw €5,000 annually and thereby build contribution years must therefore be checked against the actual insurance position. Withholding a contribution does not, by itself, establish the intended entitlement.

Residence, previous contribution classes and any cross-border insurance periods require their own review. If necessary, seek a formal insurability decision before choosing a retirement product on this basis.

Check the lifetime lump-sum limit across arrangements

Ireland’s retirement lump-sum exemption is a €200,000 lifetime limit, not a fresh allowance for each pension arrangement. Under the domestic rules, the portion above that limit up to €500,000 is taxed at 20%.

For illustration, suppose earlier retirement lump sums total €175,000 and a further €30,000 is proposed:

  • Combined retirement lump sums: €205,000.

  • Amount above the €200,000 limit: €5,000.

  • Tax at 20% on that excess: €1,000.

This illustrates the Irish domestic calculation where applicable; it does not determine treaty entitlement or Belgian taxation. Check previous payments and the scheme’s benefit limits before fixing the amount to withdraw.

A practical sequence before committing

First establish residence for the intended payment year. Then collect the full AVC documentation, contribution history and previous lump-sum record.

Next compare ARF and annuity quotations after obtaining a Belgian classification assessment and confirmation of any Irish withholding relief. Check the provider’s actual decision deadline rather than treating an ARF distribution rule as the AVC’s deadline.

An annuity may be preferable where it produces a clearer treaty outcome and suits the retiree’s needs. The conclusion remains conditional on the contract, residence, taxation and desired access to capital.

Frequently asked questions

Is an ARF taxed like an Irish pension in Belgium?

Not automatically. Revenue distinguishes ARF distributions from ordinary pension payments, and Belgian classification must also be established.

Will taking benefits in 2027 instead of 2026 remove Irish tax?

Not by itself. Residence for the payment year and the applicable treaty rules must be checked before relying on a deferral.

Does a PAYE Exclusion Order make an annuity tax-free?

It can remove Irish income-tax and USC withholding where available. It does not establish exemption in Belgium.

Can annual ARF withdrawals build Irish pension rights while I live abroad?

They should not be assumed to do so. Non-resident unearned income and the recipient’s insurance category can prevent the intended Class S treatment.

Is the €200,000 lump-sum exemption available for each pension?

No. It is a lifetime limit across retirement lump sums, so earlier payments must be included.
